Terms of Service

These Terms are an agreement between you and Kuberns Tech Private Limited (“Kuberns”). By creating an account or using our services, you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

You must be at least 18 years old to use Kuberns. Our services are not offered to anyone under 18.

Our Privacy Policy forms part of these Terms.

Kuberns is passwordless — you sign in with a one-time code or a linked Google or GitHub account. Keep access to your sign-in email and connected accounts secure. You are responsible for everything that happens under your account.

We may verify your identity, validate your payment method, apply spending limits, or delay provisioning of high-cost infrastructure where we reasonably suspect fraud or abuse.

You own your content. Your source code, applications, data and databases remain yours. Nothing in these Terms transfers ownership to us.

You grant us the licence we need to run the service for you: to clone, store, build, containerise, host, transmit and display your content, and to make copies for backup, caching and redundancy. That licence exists only to operate the service and ends when you delete the content or close your account.

You are responsible for what you deploy — that it is lawful, that you have the rights to it, and that it complies with these Terms.

Personal data inside your applications. Where your deployed applications contain personal data, you are the Data Fiduciary for it and we process it on your behalf as your Data Processor. Our Data Processing Addendum governs that processing and forms part of these Terms. You do not need to sign it separately. Where it conflicts with these Terms on the processing of personal data, the Addendum prevails.

You may authorise third-party services, applications or tools — including AI coding assistants, deployment automation, and our own AI agent — to access or act on your account.

Any action taken through your account by such a tool is treated as your own action and is subject to these Terms. You are responsible for evaluating any tool before granting it access, and for safeguarding your API keys and tokens. We are not liable for loss or unauthorised activity arising from a tool you authorised, and we may revoke or restrict third-party access at our discretion.

These rules apply to everything you deploy on Kuberns. We may suspend or remove anything that breaks them immediately and without notice.

You may not host, upload, deploy or transmitanything that is unlawful; that infringes a patent, trademark, copyright or other proprietary right; that is obscene, paedophilic, or harmful to a child; that impersonates another person; that threatens the sovereignty, integrity, defence or security of India, public order, or India’s relations with foreign states; that is knowingly false and intended to mislead; or that contains a virus, malware or any code designed to damage or interfere with a computer system.

You may not use Kuberns to:

• mine cryptocurrency;
• resell, rent or sublicense our compute to third parties;
• run open proxies, open mail relays, open recursive DNS servers, VPN or anonymisation services;
• run command-and-control infrastructure for malware, or use the service as a drop-zone for stolen data;
• test, store or process stolen payment card data;
• evade usage limits, billing limits or free-tier allowances, including by creating multiple accounts;
• send spam or unsolicited bulk email;
• run torrents, peer-to-peer file sharing, or use the service purely as file storage;
• place a disproportionate load on shared infrastructure, or degrade the service for other customers;
• conduct load testing, penetration testing or vulnerability scanning without our prior written consent;
• do anything likely to cause our IP addresses to be listed on an abuse database, or to cause our infrastructure providers to suspend or restrict us.

Reporting. Report abuse to [email protected]. We investigate every report.

Consequences. Depending on severity we may warn you, throttle or quarantine the workload, suspend the environment, suspend your account, or terminate it. We may also remove content and preserve records where the law requires it. We are not obliged to warn you first, and we are not liable for loss arising from action taken under this section.

Kuberns runs on prepaid credits. You add credits to your account, and we deduct them as your applications consume runtime and resources. You pay for runtime, not for features.

• Credits have no cash value, are non-transferable between accounts, and are non-refundable once purchased, except as described in section 10.
• Adding credits does not reserve infrastructure capacity. Resources are provisioned subject to availability in your chosen region.
• We also charge for data transfer and build minutes beyond the allowances included with your environment.
• Prices are shown before you pay. We may change prices, and any change takes effect from your next purchase — never retroactively on credits you already hold.
• Where you enable auto-recharge, you authorise us to charge your saved payment method when your balance falls below the threshold you set. You can turn it off at any time in your account settings.
• Taxes are your responsibility. Where we are required to collect tax, such as GST on transactions in India, it is shown separately and added to the amount charged.

For purchases in Indian Rupees, you are contracting with Kuberns Tech Private Limited, and payments are processed by Razorpay.

For all other purchases, Dodo Payments acts as Merchant of Record— Dodo is the legal seller for that transaction, handles applicable sales tax and VAT, and issues your invoice. Dodo’s terms apply to the payment itself; these Terms continue to govern your use of the Kuberns platform.

New accounts receive a limited number of free credits for a trial period. We may also issue promotional, referral or milestone credits.

Credits we grant rather than sell: have no cash value, are non-transferable and non-refundable, expire at the end of the trial or promotion, and may be withdrawn at any time. Free-trial infrastructure carries no availability commitment and may be stopped without notice.

Each promotional code may be redeemed once, on one account. Credits applied to accounts created to obtain them, or otherwise obtained in breach of these Terms, are void — and we may revoke them, charge you for what you used, or close the account.

Your applications run only while you have credits. We email you as your balance runs down.

We attempt a database backup before termination, but we do not guarantee one and we cannot guarantee restoration.

Where your applications run on trial credits, your environments, storage and container images may be permanently deleted 30 days after you signed up.

Where you have purchased credits, we stop the infrastructure running your applications when your balance is exhausted, but we retain your account and project configuration so you can add credits and redeploy.

You can stop using Kuberns at any time. There is no contract period and nothing to cancel — because we bill from a prepaid credit balance rather than a recurring subscription, stopping simply means not adding more credits.

Credits are non-refundable as a rule. Once purchased, credits are meant to be spent on runtime, and unused credits stay on your account rather than being returned.

That said, we will consider a refund request on its merits. If you believe your situation justifies one — you were charged in error, a duplicate payment went through, you paid for something you were unable to use, or another genuine reason — email [email protected] from the address on your account, telling us which payment you mean and why you are asking.

We will review the request and reply within 7 business days. If we approve a refund, we process it to the original payment method within a further 5 to 7 business days; how long it then takes to appear on your statement depends on your bank or card issuer. Where Dodo Payments is the Merchant of Record for your purchase (section 7), the refund is processed through Dodo.

Credits we grant rather than sell — trial, promotional, referral and milestone credits — have no cash value and are never refundable.

You may stop using Kuberns and delete your account at any time. Credits already purchased are not refunded, except as described in section 10.

We may suspend or terminate your access, immediately and without notice, if: you breach these Terms, including the acceptable use rules in section 5; your use threatens the security, stability or reputation of our platform or other customers; we reasonably suspect fraud or unlawful activity; we are required to by law; or an infrastructure provider suspends or restricts our own access to services we need to serve you.

We may also terminate for convenience on 30 days’ notice.

On termination, your right to use the service ends and we may permanently delete your content. Export anything you need first. Sections that by their nature should survive — including sections 3, 12, 13, 17, 18, 19 and 20 — survive termination.

Backups are your responsibility. We are not obliged to back up your data. Where we offer backup features, they are provided as a convenience and you should not rely on them as your only copy.

We collect and own the operational data generated by running the platform — logs, metrics, resource-usage records, traffic and performance telemetry, and usage statistics. This excludes your account information and the content of your applications.

We may use this data to operate, secure, bill for and improve the service, and may publish or share it only in aggregated or de-identified form.

If you send us suggestions or feedback about Kuberns, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use it for any purpose, without obligation to you. We will not identify you as the source without your consent.

Kuberns integrates with third-party services including GitHub, payment providers and cloud infrastructure. Your use of those services is governed by their own terms. We are not responsible for third-party services, their availability, or anything you do through them.

We respond to valid copyright complaints. If you believe content hosted on Kuberns infringes your copyright, send a notice to [email protected] identifying the work, the material, your contact details, and a statement made in good faith that the use is unauthorised.

We may remove or disable access to material in response to a valid notice or a lawful order, and we will terminate the accounts of repeat infringers. We remove content within 36 hours of a valid court order or government notification, as required by Indian law.

We do not warrant that the service will be uninterrupted, error-free or secure, that defects will be corrected, or that your applications will run without failure. We do not offer an uptime commitment on our self-serve plans. Availability depends on infrastructure providers, the public internet, and your own code and configuration — none of which we control.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost business, or lost or corrupted data, however caused, even if we were advised of the possibility.

These limits apply even if a remedy is found to have failed of its essential purpose. Nothing here excludes liability that cannot be excluded by law.

You will indemnify and hold harmless Kuberns Tech Private Limited, its officers, employees and agents from any claim, loss, liability or expense (including reasonable legal fees) arising out of: the content or applications you deploy; your breach of these Terms; your violation of any law or third-party right; or the acts of your end users or of any tool you authorised on your account.

These Terms are governed by the laws of India. The courts at Rajkot, Gujarat, India have exclusive jurisdiction, and you consent to that jurisdiction.

Before starting proceedings, contact us at [email protected] — most disputes can be resolved informally. If you are a consumer in a jurisdiction whose law gives you mandatory rights that cannot be contracted away, this section does not remove them.

Changes. We may update these Terms. We will post the updated version here with a new effective date and, where the change is significant, notify you by email or in the dashboard at least 30 days before it takes effect. Continuing to use Kuberns after that means you accept the change.

Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.

Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, including infrastructure provider failures, significant failure of the internet or a power grid, natural disasters, war, terrorism, epidemics, strikes, or government orders.

Severability and waiver. If any provision is held unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver of it.

Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between us on this subject.

Electronic communications. You consent to receive notices from us electronically, at the email address on your account.
